AHİLİK KÜLTÜRÜNDEN GÜNÜMÜZE YANSIYAN ÜÇ BOYUT: KARŞILIKLI SAYGIYA DAYALI USTA-ÇIRAK İLİŞKİLERİ TÜKETİCİYİ KORUMA VE SOSYAL GÜVENLİK İŞLEVİ

ÖZET

Bu çalışma kapsamında, kurumsal bir yapı olan ahiliğin ortaya çıkışında fütüvvet kültürünün etkilerininyadsınamazlığı üzerinde durularak; ahilik kurumunun tarihsel süreç içinde bir esnaf teşkilatı olarak oluşumundan başlayıp toplum hayatında üstlendiği rol, sosyal, ekonomik, siyasî ve askerî işlevler de nazara alınıp değerlendirilmiştir. Diğer taraftan, ahilik kültürünün toplumumuzda halen etkilerinin bulunduğu gerçeği incelenerek; ahilik kültüründe benimsenen kaidelerin bugün çalışma ilişkileri ve iş hukuku üzerindeki etkileri, usta-kalfa-çırak ilişkisi, sosyal güvenlik sistemimiz ve tüketici hukuku yönü ile irdelenmiştir. Usta-kalfa-çırak arasındaki ilişkinin, günümüz işçi-işveren ilişkilerinden nitelik olarak farkı ortaya konularak çalışma yaşamında çatışmanın değil barışçıl ortamın önemi vurgulanmış; sosyal güvenlik sistemimizde yeni bir düzenleme olan ve adını tarihi köklerinden alan "Esnaf Ahilik Sandığı" ile yapılan düzenleme; kapsamı, faydalanma koşulları ve sağladığı yardımlar çerçevesinde ana hatları ile açıklanmıştır. Yine ahiliğin tüketiciye bakış açısı incelenerek, o dönem yapılan uygulamaların bugün var olan hu- kukumuzdaki yansımaları tespit edilmeye çalışılmıştır.

THREE LEGACIES OF THE AHI ORDER’S CULTURE: MASTER- APPRENTICERELATIONSHIP BASED ON MUTUAL RESPECT, CONSUMER PROTECTION, AND SOCIALSECURITY FUNCTION

Abstract

In the present study, with reference to the undeniable influence of the futuwwa culture in the emergence of ahi orders as an organizational structure, the role the orders as an institution assumed in social settings through the era, starting with their emergence as a guild of artisans and craftsmen, were assessed from a social, economic, political and military perspective. Furthermore, on the basis of the fact that the ahi culture still reverberates in Turkish society, the influence of the guidelines embraced by the ahi culture on contemporarylabor relationships and labor law was analyzed, with special reference to the master-apprentice relationship, our social security system, and consumer law. A case was made to present the qualitative distinctiveness of the master- apprentice relationships in contrast to current labor relationships, emphasizing the importance of amicability rather than conflict in these contexts. Also present is a detailed discussion of the Artisans and Craftsmen Ahi Guild Fund, which is a recent addition to our social security system, and which was named after its antecedents, detailing the fund’s scope, terms of application, and benefits, and trying to underline the importance of this arrangement – however imperfect it may beproviding some security for the artisans and craftsmen against unemployment. Moreover, the ahi order’s attitudes towards the consumers were also reviewed, trying to identify the current consumer law reflections of the practices introduced back in the day of the order.
